RE: The tariff classification of plastic and textile gloves from China.
Dear Ms. Gregersen:
In your letter dated April 4, 1995, on behalf of Island Trading, you requested a classification ruling.
Style NG15 is a flocked lined seamless nitrile rubber glove with an embossed palm fingers and thumb. The glove has a 12 inch gauntlet cuff.
Style 3005/10L is a 100% cotton woven work glove. The clute cut glove features an applied knit cuff.
Style 810RB is a 100% knit cotton glove dipped in PVC. The 10 inch glove has a unfinished hand opening and a smooth finish. The glove contains over 50 percent by weight of PVC.
Style EL33K is a 100% knit glove. The glove was dipped in a textured rubber coating and is described by you as being over 50% rubber by weight. The glove features a woven 2 1/2" safety cuff.
Style PE0913 is a pair of transparent disposable gloves made of polyethylene. The glove is seamed by heat sealing around the edges of the finger and the hand.
The applicable subheading for style NG15, will be, 4015.19.1050, Harmonized Tariff Schedule of the United States (HTS), which provides for articles of apparel and clothing accessories (including gloves), for all purposes, of vulcanized rubber other than hard rubber: gloves: other: seamless, other. The duty rate will be 3.6 percent ad valorem.
The applicable subheading for style 3005/10L, will be 6216.00.3800, HTS, which provides for gloves, mittens and mitts: other: of cotton: other: without fourchettes. The duty rate will be 24.8 percent ad valorem.
The applicable subheading for styles 810RB and EL33K, will be 6116.10.6500, HTS, which provides for gloves, mittens and mitts: impregnated, coated or covered with plastics or rubber: other: without fourchettes: other: other. The duty rate will be 13.3% percent ad valorem.
The applicable subheading for style PE0913, will be 3926.20.4010, HTS, which provides for articles of apparel and clothing accessories: gloves: other, disposable. The duty rate will be 13.2% percent ad valorem.
Style 3005/10L falls within textile category designation 331. Based upon international textile trade agreements, products of China are subject to visa restrictions and quota restraints.
The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.
This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
