RE: The tariff classification of a candleholder from the Philippines.
Dear Ms. Lorentz:
In your letter dated September 28, 1995, you requested a tariff classification ruling.
The sample submitted is the "Wood and Tin Santa Chime Candleholder," item number 11272-4, which consists of a wooden slenderized Santa-like figurine affixed to an oblong-shape wooden base. It is noted that this figurine, measuring approximately 7 inches long, is holding a small metal candleholder and wearing metal wings as well as a small heart-shape ornament affixed to the top of the cap.
The applicable subheading for the "Wood and Tin Santa Chime Candleholder," item number 11272-4, will be 9405.50.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for other non-electrical lamps and lighting fittings. The duty rate will be 7.3 percent ad valorem.
Articles classifiable under subheading 9405.50.4000, HTS, which are products of the Philippines, are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations, if the GSP is renewed.
This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
