RE: The tariff classification of open work knit fabric from Korea
Dear Mr. Natale:
In your letter dated January 7, 2000, you requested a tariff classification ruling on behalf of Strong Man Building Products.
You submitted samples of three styles of knit fabric. They are identified as SBN 14-60, SBN-22 and SBF-427. You state that they are all made of 100 percent polyethylene and are warp knit. They all have the appearance of open work fabric; having stable, regularly spaced openings in the fabric. The fabrics are intended for use at construction sites to prevent falling debris from causing injury or damage.
The applicable subheading for the fabrics will be 6002.43.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for other fabrics, warp knit, of man-made fibers, open-work fabrics. The rate of duty will be 11.6 percent ad valorem.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Camille Ferraro at 212-637-7086.
Sincerely,
