RE: The tariff classification of shelving, a wire garment rack, a wire underbed cart, a 2-tier shoe rack and a 3-basket cart from China.

Dear Mr. Fodor:

In your letter dated March 13, 2001, on behalf of Earle Industries, you requested a ruling on tariff classification.

The merchandise to be imported is as follows:

Commercial Supreme Shelving consists of a floor standing shelving unit made of chrome steel. The shelving has a 500 pound capacity and adjustable shelves with one-inch increments.

Closet Supreme Wire Garment Rack consists of a floor standing rack made of chrome steel. The garment rack has a top shelf, a bottom shelf, a chrome hanging bar which holds 36 to 50 garments, and screw-in wheels. The garment rack has a 350 pound shelf capacity.

Closet Supreme Wire Underbed Cart consists of a floor standing cart made of chrome steel with wheels.

2 Tier Supreme Shoe Rack consists of a floor standing rack made of tubular chrome steel with adjustable racks. The rack expands from 24” to 46”.

Supreme 3 Basket Cart consists of a floor standing cart made of chrome steel. The cart has a top shelf, bottom shelf and 3 baskets.

The applicable subheading for the shelving, the wire garment rack and the 2-tier shoe rack will be 9403.20.0020, Harmonized Tariff Schedule of the United States (HTS), which provides for other furniture and parts thereof: other metal furniture, other: counters, lockers, racks, display cases, shelves, partitions and similar fixtures. The rate of duty will be free.

The applicable subheading for the wire underbed cart and the 3-basket cart will be 9403.20.0030, HTS, which provides for other furniture and parts thereof: other metal furniture, other: other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
