We have been asked to review New York Ruling Letter #844343
of August 18, 1989, and have determined that an error was made
during the original classification of your hand-operated
pneumatic tool. The proper classification for your merchandise
under the Harmonized Tariff Schedule of the United States
(HTSUSA) is heading 8467.19.10. This subheading provides for
other pneumatic tools for working in the hand, suitable for metal
working.
The applicable rate of duty for subheading 8467.19.10,
HTSUSA, is 4.5 percent ad valorem.
