RE: Clarification of HQ 966562 regarding Stainless Steel Grid Wires Used in Multifunctional Digital Copier Units,
Dear Ms. Struder:
On March 4, 2004, Customs and Border Protection (CBP) issued HQ 966562, to you, which concerns the classification of two stainless steel grid wires used in multifunctional digital copier units under the Harmonized Tariff Schedule of the United States (HTSUS). CBP classified one grid wire, Part # AD02-0001, in subheading 7222.20.00, HTSUS as “Other bars and rods of stainless steel; angles, shapes and sections of stainless steel: Bars and rods, not further worked than cold-formed or cold finished.” The second grid wire, Part # ADO23-9006 was classified in subheading 8473.30.50, HTSUS as “Parts and accessories (other than covers, carrying cases and the like) suitable for use solely or principally with machines of headings 8469 to 8472: Parts and accessories of the machines of heading 8471: Not incorporating a cathode ray tube: Other.” In HQ 966562, we indicated that the grid wires were being used in photocopiers. Upon review of HQ 966562, we have determined that this information regarding the use of the grid wires in photocopiers was inaccurate. The machines in which the gird wires are used, the Aficio 6010 and Aficio 2010, are not photocopiers, but multifunctional digital copier units. Because the parts used in photocopiers and digital copiers are classified differently, in order to avoid confusion, we believe that HQ 966562 must be corrected to delete all references to photocopiers.
Parts used in digital copiers are classified in subheading 8473.30.50, HTSUS. In HQ 966562, we held that one of the grid wires under consideration, Part # ADO23-9006, was classified in subheading 8473.30.50, HTSUS. Despite the inaccurate reference to photocopiers, we classified the grid wire Part # ADO 23-9006 as a part of a digital copier rather than as a part of a photocopier. This classification for this article is correct. In addition, the classification of the other grid wire under consideration, part #
AD02-0001, is not affected by the reference to photocopiers in the ruling and
also remains correct. Therefore, the classifications held in HQ 966562 are unchanged and the ruling is corrected only to the extent of changing all references to photocopiers to digital copier multifunctional units.
