RE: The tariff classification of toasted garlic products from China

Dear Mr. Zou:

In your letter dated May 12, 2015 you requested a tariff classification ruling.

You provided photo images, and the garlic-toasted processing chart for five products. Toasted Sliced Garlic, Toasted Chopped Garlic, Toasted Minced Garlic, Toasted Granulated Garlic, and Toasted Powdered Garlic are said to be prepared from fresh garlic being sorted, peeled, washed, and sliced. It will be dried at 50 to 60 degrees Celsius for 5 to 6 hours, and then toasted at 40 to 50 degrees Celsius for 3 to 4 hours. A portion of the toasted sliced garlic will be selected, packed and stored, and another portion will be chopped, minced, granulated, and powdered making four additional products.

The applicable subheading for the five toasted garlic products will be 2005.99.9700, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other vegetables prepared or preserved otherwise than by vinegar or acetic acid, not frozen, other than products of heading 2006 . . . other vegetables and mixtures of vegetables . . . other . . . other. The general rate of duty will be 11.2 percent ad valorem.
