RE: The tariff classification of a golf umbrella from China.
Dear Mr. Heck:
In your letter dated May 3, 1995 on behalf of World Import Co., you requested a tariff classification ruling.
The sample submitted "Flagbrella" (UPC #7-28546-12310-5) is a 100% nylon, 8 ribbed/8 panel, wooden handled, push-button automatic, non-telescopic golf umbrella. The nylon umbrella material has red, white and blue stars and stripes with approximately 4" square letters on one panel stating "USA". In it's imported condition, the Flagbrella will be collapsed (concealing the USA lettering), will have a clear PVC cone shaped case and will have a permanently sewn in label on one rib stating "100% Nylon, Made in China". The marking of the "Flagbrella" as stated is acceptable.
The applicable subheading for the "Flagbrella" will be 6601.99.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for Umbrellas and sum umbrellas (including walking-stick umbrellas, garden umbrellas and similar umbrellas): Other: Other. The rate of duty will be 8.2 percent ad valorem.
This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
