RE: The tariff classification of a jewelry box, trinket box,
jewelry roll, jewelry pouches, and a toiletry bag containing
makeup brushes from China.
Dear Mr. Peck:
In your letter dated May 17, 1995, on behalf of CBI
Distributing Corp., you requested a classification ruling.
You have submitted seven samples with your request which are
all composed of 100 percent cotton woven fabric. They are as
follows:
Style 15864 is a specially shaped and fitted jewelry box
composed of a paperboard base covered internally and externally
with 100 percent cotton fabric. The interior has a lift-out
fitted top tray divided into three compartments and a ring
section. Underneath the top tray is a full-width storage
compartment. There is a fitted mirror within the hinged lid.
The item measures approximately 6" x 4 1/2" x 2 1/4".
Style 15874 is a small oval trinket box measuring
approximately 2 inches in height. The box has two parts, a lower
section and a detachable lid. The exterior lid and interior
bottom is padded with foam.
Style 17698 is a jewelry pouch designed with an attached
disc to contain earrings. It measures approximately 5 inches by
5 inches. The top is secured by means of a hook and loop
fastener.
Style 15868 is a jewelry roll measuring approximately 10 1/2
inches by 7 inches in its unfolded position. The interior is
specially designed with a full-width open storage pocket, several
zippered compartments and an affixed snap jewelry roll designed
to contain rings. The item is secured by means of a wrap-a-round
braided tie closure.
Style 15869 is a drawstring jewelry pouch. The interior is
designed with pockets to contain individual pieces of jewelry
during travel.
Style 15851 is a cosmetic bag measuring approximately 7
inches by 5 inches. The bag is secured by means of a flap with a
zippered closure. There is a fitted mirror within the flap
closure.
Style 17719 is a bifold toiletry bag fitted to contain
various makeup brushes and combs. One side of the interior has a
zippered toiletry bag of clear plastic; one side features fitted
slots which contains the makeup brushes and combs. For
classification purposes the item is considered to be a set (GRI
3(b) noted). The bag will impart the essential character. The
item is secured by means of a wrap-a-round tie string closure.
Your samples are being returned as you requested.
The applicable subheading for Style 15864, the jewelry box
of 100 percent cotton, will be 4202.92.6090, Harmonized Tariff
Schedule of the United States (HTS), which provides for trunks,
suitcases...; jewelry boxes and similar containers, with outer
surface of textile materials, other, of cotton. The duty rate
will be 7.1 percent ad valorem.
The applicable subheading for Style 15874, the trinket box
of 100 percent cotton, will be 6307.90.9989, HTS, which provides
for Other made up articles... Other: Other, Other. The duty rate
will be 7 percent ad valorem.
The applicable subheading for Styles 17698, 15868, 15869,
15851 and 17719, the earring pouch,jewelry roll, jewelry pouch,
cosmetic bag and toiletry bag (with brushes as a set) of 100
percent cotton, will be 4202.92.1500, HTS, which provides for
travel, sports and similar bags, with outer surface of textile
materials, of vegetable fibers and not of pile or tufted
construction, of cotton. The duty rate will be 7.1 percent ad
valorem.
Items classifiable under 4202.92.6090 and 4202.92.1500 fall
within textile category designation 369. Based upon
international textile trade agreements products of China are
subject to quota and the requirement of a visa.
The designated textile and apparel categories may be
subdivided into parts. If so, visa and quota requirements
applicable to the subject merchandise may be affected. Since
part categories are the result of international bilateral
agreements which are subject to frequent renegotiations and
changes, to obtain the most current information available, we
suggest that you check, close to the time of shipment, the Status
Report on Current Import Quotas (Restraint Levels), an internal
issuance of the U.S. Customs Service, which is available for
inspection at your local Customs office.
This ruling is being issued under the provisions of Section
177 of the Customs Regulations (19 C.F.R. 177).
A copy of this ruling letter should be attached to the entry
documents filed at the time this merchandise is imported. If the
documents have been filed without a copy, this ruling should be
brought to the attention of the Customs officer handling the
transaction.
