RE: The tariff classification of two women's knit garments from Hong Kong.
Dear Ms. Conigliaro:
In your letter dated August 11, 1995 you requested a tariff classification ruling. Your samples are being returned.
You submitted two samples. Style number 170 is a woman's sweater constructed from 100% acrylic, chenille knit fabric. The outer surface of the sweater measures less than 9 stitches per 2 centimeters horizontally. The sweater features a pointed collar; shoulder pads; long, hemmed sleeves; a full front, double-breasted opening with a zipper closure; two slant, inset, front zipper pockets at the waist; and a capped bottom with eyelet and string decorations. A decorative applique (beads and yarn) is sewn on each shoulder.
Style number 438 is a woman's suit-type jacket constructed from 70% acrylic, 30% wool, doubleknit fabric. The garment consists of four panels, two of which are at the front, sewn together lengthwise. The garment features shoulder pads; long hemmed sleeves; a full front opening with a 7 button closure; 2 one button, chest pockets; 2 one button, patch pockets at the waist; and a hemmed bottom. The sleeve cuffs, and pockets are finished with decorative cording.
The applicable subheading for the sweater will be 6110.30.3020, Harmonized Tariff Schedule of the United States (HTS), which provides for women's sweaters, knitted: of man-made fibers: other. The duty rate will be 34% ad valorem. The applicable HTS subheading for the suit-type jacket will be 6104.33.1000, which provides for women's suit-type jackets, knitted: of synthetic fibers: containing 23% by weight of wool or fine animal hair. The duty rate will be 67.1 cents/kg + 19.6% ad valorem.
Style 170 falls within textile category designation 646. Style 438 falls in category 435. Based upon international textile trade agreements products of Hong Kong are subject to quota restraints and the requirement of a visa.
The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.
This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
