RE: The tariff classification of 100% cotton woven fabrics from Belgium
Dear Ms. Thompson:
In your letter dated January 2, 1996, on behalf Omexco S.A., you requested a tariff classification ruling.
Two samples of woven fabric accompanied your request for a ruling. The first, designated as style Velasquez, is printed 100% cotton fabric. Laboratory analysis indicates that this product is woven as a plain weave except that each group of two warp ends are woven as one (taped warp). This fabric contains 33.9 single yarns per centimeter in the warp and 15.7 single yarns per centimeter in the filling. It is constructed using 14/1 c.c. yarns in the warp and 12/1 c.c. yarns in the filling. Weighing 233.9 g/m2, this fabric will be imported in 140 centimeter widths. Based on the data developed by the Customs Laboratory, the average yarn number for this product has been calculated to be 21 in the metric system.
The sample, designated as style Cotton Club, is a 100% cotton woven fabric composed of yarns of different colors. It is manufactured using a combination weave characterized by sections of plain weave and sections of twill weave. It contains 67 warp ends per centimeter and 23 filling picks per centimeter. Weighing 318.4 g/m2, this product will be imported in 140 centimeter widths.
The applicable subheading for the printed woven fabric designated as style Velasquez will be 5209.59.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for woven fabrics of cotton, containing 85 percent or more by weight of cotton, weighing more than 200 g/m2, printed, other fabrics, duck, except plain weave. The rate of duty will be 8.8 percent ad valorem.
The applicable subheading for the woven fabric designated as style Cotton Club will be 5209.49.0090, HTS, which provides for woven fabrics of cotton, containing 85 percent or more by weight of cotton, weighing more than 200 g/m2, of yarns of different colors, other fabrics, other. The rate of duty will be 8.8 percent ad valorem.
This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
