RE: The tariff classification of home saunas from Japan.
Dear Mr. Kubli:
In your letter dated June 29, 1989 you requested a tariff
classification ruling on behalf of Watahan Homesauna of Tokyo,
Japan.
The item for which you requested classification is a home
sauna. The sauna consists of an electric zirconia ceramic heater
which is housed in a portable, expandable wooden enclosure. Other
devices such as thermostat, control panel, and bench are included
in the housing. The sauna incorporates no water or steam, but
operates solely by means of the emission of "super extreme"
infrared rays from the heating apparatus.
The applicable subheading for the home sauna will be
8516.29.0090, Harmonized Tariff Schedule of the United States
(HTS), which provides for other electric space heating apparatus.
The rate of duty will be 3.7 percent ad valorem.
This ruling is being issued under the provisions of Section
177 of the Customs Regulations (19 C.F.R. 177).
A copy of this ruling letter should be attached to the entry
documents filed at the time this merchandise is imported. If the
documents have been filed without a copy, this ruling should be
brought to the attention of the Customs officer handling the
transaction.
