RE: The tariff classification of steel sheet and strip from West
Germany.
Dear Mr. Martin:
In your letter dated June 26, 1990, you requested a tariff
classification ruling.
You plan to import silicon free nonalloy grades of cold-
rolled steel sheet and strip for use in electrical applications.
These silicon free grades of flat-rolled steel, known by the
trade name Sepromax, will be imported in coil form in thicknesses
of 0.50, 0.65, 0.75, and 1.00 mm and in widths ranging from 52 to
1500 mm. After cold-rolling, the Sepromax grades of steel are
annealed and then rerolled in the skin pass mill. The minimum
yield points of these products vary; some of these flat-rolled
products have a minimum yield point of less than 275 MPa and some
have a minimum yield point of 275 MPa or higher.
The applicable subheading for the silicon free cold-rolled
flat-rolled products measuring 600 mm or more in width and having
a minimum yield point of 275 MPa will be 7209.13.00, Harmonized
Tariff Schedule of the United States (HTS), which provides for
flat-rolled products of iron or nonalloy steel, of a width of 600
mm or more, cold-rolled, not clad, plated or coated, in coils,
not further worked than cold-rolled, of high strength steel, of a
thickness of 0.5 mm or more but not exceeding 1 mm. The rate of
duty will be 5.1 percent ad valorem.
The applicable subheading for the silicon free cold-rolled
flat-rolled products measuring 600 mm or more in width and having
a minimum yield point of less than 275 MPa will be 7209.23.00,
HTS, which provides for flat-rolled products of iron or nonalloy
steel, of a width of 600 mm or more, cold-rolled, not clad,
plated or coated, other, in coils, not further worked than cold-
rolled, of a thickness of 0.5 mm or more but not exceeding 1 mm.
The rate of duty will be 5.1 percent ad valorem.
The applicable subheading for the silicon free cold-rolled
flat-rolled products measuring less than 300 mm in width and
having a minimum yield point of 275 MPa will be 7211.30.10, HTS,
which provides for flat-rolled products of iron or nonalloy
steel, of a width of less than 600 mm, not clad, plated or
coated, not further worked than cold-rolled, of high-strength
steel, of a width of less than 300 mm, of a thickness exceeding
0.25 mm. The rate of duty will be 3.4 percent ad valorem.
The applicable subheading for the silicon free cold-rolled
flat-rolled products measuring less than 300 mm in width and
having a minimum yield point of less than 275 MPa will be
7211.41.30, HTS, which provides for flat-rolled products of iron
or nonalloy steel, of a width of less than 600 mm, not clad,
plated or coated, other, not further worked than cold-rolled,
containing by weight less than 0.25 percent of carbon, of a width
of less than 300 mm, of a thickness exceeding 0.25 mm but not
exceeding 1.25 mm. The rate of duty will be 3.4 percent ad
valorem.
The applicable subheading for the silicon free cold-rolled
flat-rolled products measuring 300 mm or more but less than 600
mm in width and having a minimum yield point of 275 MPa will be
7211.30.50, HTS, which provides for flat-rolled products of iron
or nonalloy steel, of a width of less than 600 mm, not clad,
plated or coated, not further worked than cold-rolled, of high-
strength steel, other. The rate of duty will be 5.1 percent ad
valorem.
The applicable subheading for the silicon free cold-rolled
flat-rolled products measuring 300 mm or more but less than 600
mm in width and having a minimum yield point of less than 275 MPa
will be 7211.41.70, HTS, which provides for flat-rolled products
of iron or nonalloy steel, of a width of less than 600 mm, not
clad, plated or coated, other, not further worked than cold-
rolled, containing by weight less than 0.25 percent of carbon,
other. The rate of duty will be 5.1 percent ad valorem.
This ruling is being issued under the provisions of Section
177 of the Customs Regulations (19 C.F.R. 177).
A copy of this ruling letter should be attached to the entry
documents filed at the time this merchandise is imported. If the
documents have been filed without a copy, this ruling should be
brought to the attention of the Customs officer handling the
transaction.
