RE: The tariff classification of various twisted and braided ropes from China
Dear Ms. Fan:
In your letter dated January 4, 1993, received in this office January 20, 1993, you requested a classification ruling.
You have enclosed short samples, one to five inches in length, of 12 ropes of various types, as follows (the names shown are those on the labels attached to the samples):
1. POLYPROPYLENE NO. 17: a braided rope approximately 6 cm in diameter, consisting of 8 strands of multifilament polypropylene, braided together.
2. POLYPROPYLENE 06: a three-strand twisted rope approximately 4 cm in diameter, made of polypropylene multifilament.
3. POLYETHYLENE 10: a three-strand twisted rope approximately 1.5 cm in diameter, made of polyethylene multifilament.
4. 09 PE 09: a three-strand twisted rope approximately 1 cm in diameter. It is made of a multifilament, which we assume is polyethylene.
5. 04 PP 04: a three-strand twisted rope approximately 1 cm in diameter. It is made of a multifilament, which we assume is polypropylene.
6. POLYPROPYLENE APP50: a three-strand twisted rope approximately 2 cm in diameter, made of polypropylene strip which has been folded and twisted. The strip is nonfibrillated, and is 30 cm in width when unfolded.
7. NYLON AN90 7/8": a three-strand twisted rope approximately 2.5 cm in diameter, made of nylon multifilament.
8. NYLON AN70 5/8": a three-strand twisted rope approximately 2 cm in diameter, made of nylon multifilament.
9. 11 NYLON: a three-strand twisted rope approximately 1.5 cm in diameter, made of nylon multifilament.
10. 14 VINYLON 14: a three-strand twisted rope approximately 2 cm in diameter, made of spun vinylon staple fibers. Vinylon is a polyvinyl alcohol fiber.
11. NYLON 07: a three-strand twisted rope approximately 8 mm in diameter, made of nylon multifilament.
12. NYLON AN20 1/4": an eight-strand braided rope with a untwisted core, made of nylon multifilament. The rope is approximately 7 mm in diameter.
You have not indicated the linear density of these ropes. However, we estimate that all of them measure well over 10,000 decitex.
The applicable subheading for item 1 will be 5607.49.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for twine, cordage, ropes and cables, whether or not plaited or braided and whether or not impregnated, coated, covered or sheathed with rubber or plastics; of polyethylene or polypropylene; other; other. The duty rate will be 7.2 percent ad valorem.
The applicable subheading for items 2, 3, 4 and 5 will be 5607.49.2500, HTS, which provides for twine, cordage, ropes and cables, whether or not plaited or braided and whether or not impregnated, coated, covered or sheathed with rubber or plastics; of polyethylene or polypropylene; other, not braided or plaited; other. The duty rate will be 15 percent ad valorem plus 27.6 cents per kilogram.
The applicable subheading for item 6 will be 5607.49.1000, HTS, which provides for twine, cordage, ropes and cables, whether or not plaited or braided and whether or not impregnated, coated, covered or sheathed with rubber or plastics; of polyethylene or polypropylene; other; of wide nonfibrillated strip. The duty rate will be 5.3 percent ad valorem.
The applicable subheading for items 7, 8, 9, 10 and 11 will be 5607.50.2000, HTS, which provides for twine, cordage, ropes and cables, whether or not plaited or braided and whether or not impregnated, coated, covered or sheathed with rubber or plastics; of other synthetic fibers; not braided or plaited. The duty rate will be 15 percent ad valorem plus 27.6 cents per kilogram.
The applicable subheading for item 12 will be 5607.50.4000, HTS, which provides for twine, cordage, ropes and cables, whether or not plaited or braided and whether or not impregnated, coated, covered or sheathed with rubber or plastics; of other synthetic fibers; other. The duty rate will be 7.2 percent ad valorem.
Items 2, 3, 4, 5, 7, 8, 9, 10 and 11 fall within textile category designation 201. Items 1 and 12 fall within textile category designation 669. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.
The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.
This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
