RE: The tariff classification of rainwear from China
Dear Mr. Terrell:
In your letter dated July 21, 1997, you requested a tariff classification ruling.
The submitted sample, style 3000, is a unisex 3 piece rain suit made of 100% polyester coated with PVC. The PVC completely obscures the underlying fabric. The rain suit consists of a jacket, hood, and bib pants. The jacket has a full frontal opening with 4 snap closures and a storm flap, a corduroy collar with snap closure, two patch pockets with flaps and snap closures, snap cuffs at the wrist and a storm flap on the back. . There are two air vents under each arm. The hood snaps onto the jacket and has a drawstring closure. The bib style pants have elastic straps, a snap fly front and snap cuffs. The Mid West logo is printed on the flap of the left pocket of the jacket and the on the left side of the bib of the pants. The sample will be returned as requested.
The applicable subheading for the rain suit will be 6210.30.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for garments, made up of fabrics of heading 5602, 5603, 5903, 5906 or 5907: other garments, of the type described in subheadings 6202.11 to 6202.19: of man-made fibers: having an outer surface impregnated, coated, covered, or laminated with rubber or plastics material which completely obscures the underlying fabric. The rate of duty will be 6.5 percent ad valorem.
There is no textile category designation at this time. Based upon international textile trade agreements, products of China are subject to quota and the requirement of a visa.
The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close
to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
