RE: The tariff classification of glass ampoules from Canada
Dear Mr. Rodriguez:
In your letter dated March 1, 1999, on behalf of your client, Schering Plough Products, Inc., you requested a tariff classification ruling of a new product that was not ruled on in
PC A83625 dated December 10, 1996. A representative sample of the item was submitted with your ruling request.
You indicated in your letter that the subject merchandise, glass ampoules, will be used to fill a drug called “Ethamoline”, which will be sold in the United States. The item will be imported in two sizes: 2ml and 10ml.
The applicable subheading for the glass ampoules will be 7010.10.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for carboys, bottles, flasks, jars, pots, vials, ampoules and other containers, of glass, of a kind used for the conveyance or packing of goods: ampoules. The rate of duty will be free.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
