RE: The tariff classification of Resimene 750, Resimene BM 5901 and Resimene BM 7512 from Canada.
Dear Ms. Pierce:
In your letter dated March 26, 1999, you requested a tariff classification ruling.
Based on the technical literature submitted, Resimene 750 is a butylated melamine-formaldehyde resin solution composed of approximately 78-82 percent butylated melamine-formaldehyde resin, 18-22 percent n-butanol and 2.25 percent formaldehyde, by weight. Resimene BM 5901 is a butylated melamine-formaldehyde resin solution composed of approximately 78-82 percent resin solids, 19 percent n-butanol and 1 percent formaldehyde, by weight. Resimene BM 7512 is a butylated melamine-formaldehyde resin solution composed of approximately 93-97 percent resin solids, 4 percent n-butanol and 0.25 percent formaldehyde, by weight.
The applicable subheading for the Resimene 750, Resimene BM 5901 and Resimene BM 7512 will be 3909.20.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for Amino-resins, phenolic resins and polyurethanes, im primary form: Melamine resins. The rate of duty will be 6.5 percent ad valorem.
