RE: The tariff classification of steel strapping from Korea.
Dear Mr. Brady:
In your letter dated April 21, 1999 on behalf of Hankook Metal Ind. Co., Ltd., you requested a tariff classification ruling. Descriptive literature was submitted with your ruling request.
The products to be imported are cold-rolled painted nonalloy steel strapping and cold-rolled zinc-coated nonalloy steel strapping which range from 0.30 mm to 1.20 mm in thickness and from 9.5 mm to 32 mm in width. The strapping will be imported either in coils of successively superimposed layers or in oscillated wound coils. The strapping material comes in three grades with varying carbon contents: Standard with a carbon content which ranges from 0.12% to 0.18%, Hi-Tensile with a carbon content which ranges from 0.17% to 0.23%, and Super with a carbon content which ranges from 0.22% to 0.29%. You stated that the zinc-coated strapping is zinc painted. It is assumed that this is an organic or inorganic zinc-rich paint and not a metallic zinc coating.
The applicable subheading for the cold-rolled painted and the organic or inorganic zinc-rich paint coated nonalloy steel strapping in coils of successively superimposed layers will be 7212.40.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for flat-rolled products of iron or nonalloy steel, of a width of less than 600 mm, clad, plated or coated, painted, varnished or coated with plastics, of a width of less than 300 mm. The rate of duty will be 1.7 percent ad valorem.
The applicable subheading for the cold-rolled flat-rolled painted and the organic or inorganic zinc-rich paint coated nonalloy steel strapping which is not coiled in successively superimposed layers will be 7217.90.50, HTS, which provides for wire of iron or nonalloy steel, other, other. HTS subheading 7217.90.5030 is applicable for the Standard, Hi-Tensile and Super grades which contain by weight less than 0.25% of carbon. HTS subheading 7217.90.5060 is applicable for the Super grade that contains by weight 0.25% or more but less than 0.6% carbon. The rate of duty for 7217.90.50 will be 2.6 percent ad valorem.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
