RE: The tariff classification of stainless steel strip from Germany.
Dear Mr. Kelley:
In your letter dated September 10, 1999 on behalf of ZAPP USA INC. and your sister company, Ergste Westig Massachusetts L.P., you requested a tariff classification ruling. Representative samples of the product to be imported were submitted with your request.
The product to be imported is cold-rolled ARGESTE 1.4310 FF stainless steel strip measuring 0.13 mm in thickness and 15 mm in width. This stainless steel material will ultimately be used in the manufacture of relay springs and reed valves.
The applicable subheading for the cold-rolled ARGESTE stainless steel strip will be 7220.20.9030, Harmonized Tariff Schedule of the United States (HTS), which provides for flat-rolled products of stainless steel, of a width of less than 600 mm, not further worked than cold-rolled (cold-reduced), of a width of less than 300 mm, of a thickness not exceeding 0.25 mm, other, containing more than 0.5 percent but less than 24 percent by weight of nickel. The rate of duty will be 4 percent ad valorem.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
You ask whether the ARGESTE stainless steel strip material is exempt from antidumping duties. Customs does not issue binding rulings on antidumping matters. The Department of Commerce issues scope rulings. We can provide you with some information regarding your concerns. Antidumping case A-428-825 covers certain stainless steel sheet and strip in coils from Germany. Attached is information on the scope of the order for this case and information regarding the specific products that are excluded from the scope of this order.
