RE: The tariff classification of a safety kit from Hong Kong.
Dear Mr. Swanson:
In your letter dated September 20, 1999, you requested a classification ruling. Sample is being returned as requested.
The sample submitted is a general safety kit, referred to as “Safety Packs,” which consists of the following components: a plastic flashlight, measuring 6 ½ inches in length, with flip-open storage compartment, belt clip and carrying strap; a metal key chain with identification case; a metal whistle with lanyard; a notepad; a pencil; bandaids; sanitary towelettes; reflective straps; and a textile belt pouch of man-made fibers.
The applicable subheading for the flashlight will be 8513.10.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for portable electric lamps designed to function by their own source of energy…lamps: flashlights. The duty rate will be 12.5 percent ad valorem.
The applicable subheading for the identification key chain will be 7326.20.0050, HTS, which provides for other articles of iron or steel, other. The rate of duty will be 3.9 percent ad valorem.
The applicable subheading for the whistle with lanyard will be 9208.90.0080, HTS, which provides for whistles. The rate of duty will be 5.3 percent ad valorem.
The applicable subheading for the notepad will be 4820.10.2020, HTS, which provides for memorandum pads, letter pads and similar articles, and dutiable at the rate of 2 percent ad valorem.
The appropriate subheading for the pencil will be 9609.10.0000, HTS, which provides for pencils and crayons with leads encased in a rigid sheath. The rate of duty will be 14 cents per gross plus 4.3 percent ad valorem.
The appropriate subheading for the bandaids will be 3005.10.5000, HTS, which provides for adhesive dressings and other articles having an adhesive layer: other. The rate of duty will be free.
The appropriate subheading for the sanitary towelettes will be 5603.12.0010, HTS, which provides for nonwovens, whether or not impregnated, coated, covered or laminated: of man-made filaments: weighing more than 25 grams per square meter but not more than 70 grams per square meter, impregnated, coated or covered with material other than or in addition to rubber, plastics, wood pulp or glass fibers. The rate of duty will be free.
The appropriate subheading for the reflective straps will be 3926.90.9880, HTS, which provides for other articles of plastics, other. The rate of duty will be 5.3 percent ad valorem.
The appropriate subheading for the textile belt pouch will be 4202.92.9026, HTS, which provides for traveling bags, toiletry bags, knapsacks…tool bags, sport bags…with outer surface of textile materials: other: of man-made fibers. The rate of duty will be 18.8 percent ad valorem.
Tariff number 5603.12.0010, HTS, falls within textile category designation 223. Based upon international textile trade agreements products of Hong Kong are subject to quota..
Tariff number 4202.92.9026, HTS, falls within textile category number 670. Based upon international textile trade agreements products of Hong Kong are subject to quota and the requirement of a visa.
The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
