RE: The tariff classification of a pool skimmer from South Africa.
Dear Mr. Alberdi:
In your letter dated October 29, 1999, you requested a tariff classification ruling.
You are requesting the tariff classification on a product that is a pool skimmer. The product’s name is the “Poolskim” and it is designed to fit all standard aimflows. An aimflow is the fitting on the inlet pipe of a pool where the water is pumped back into the pool. The “Poolskim” will skim the surface of a pool and remove all floating debris such as leaves, grass clippings and insects. The item is considered a pool accessory for the purposes of the Harmonized Tariff Schedule of the United States (HTSUS). There was no sample submitted with the ruling request, however an informative color brochure was included as part of the ruling request package.
The applicable subheading for the pool skimmer called the “Poolskim” will be 9506.99.5500, Harmonized Tariff Schedule of the United States (HTS), which provides for “Swimming pools and wading pools and parts and accessories thereof.” The rate of duty will be 5.3 percent ad valorem.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
