RE: The tariff classification of five coated/laminated textile fabrics and various articles produced from such materials, from France.
Dear Mr. Mlockier
In your letter dated January 25, 2000, you requested a classification ruling. In general, a request for a ruling is limited to five items, see accompanying pipeline.
Because of the number of different samples submitted involving a wide range of tariff subheadings, your request was divided into related groups. The appropriate National Import Specialists will address their merchandise under separate cover.
This letter will address only the piece goods identified by your letters as A (Plastifilm), C (Moltonap) and one of the materials (Molleton) of the L group (table protector). Sufficient information was lacking for the goods of these groups indicated as “ready made packaged”.
The first item, “A”, consists of woven fabric composed of cotton. This fabric has been printed with a floral design and then coated/laminated on the printed side with a clear polyvinyl chloride plastics film which is visible to the naked eye. You indicate that this material is 63% PVC, 37% Cotton, by weight, respectively.
The second item, “C”, consists of woven fabric composed of cotton. This fabric has been brushed on one side and printed with a floral design on the other before being coated/laminated on the printed side with a clear polyvinyl chloride plastics film which is visible to the naked eye. This material is stated to be 60% Cotton, 40% PVC, by weight, respectively.
The third and final item that we will address in this letter, is “L” which contains three individual samples. The first, (Molleton) consists of a woven cotton fabric that has been brushed on one side and coated/laminated on the other with a clear polyvinyl chloride plastics material which is visible to the naked eye. This material is stated to be composed of 59% PVC, 41% Cotton, by weight, respectively.
With respect to the goods indicated as “ready made packaged”, we would need to know, for a definitive classification, how they are packaged, the shape and dimension of the item and a representative section (do not need the whole item) showing how the edge is finished.
The second sample of the L group (Isomousse) consists of a knit fabric composed of unspecified fibers that has been coated/laminated on one side with a cellular PVC plastics material. This plastics portion has been embossed with a geometric pattern and is stated to be 90% PVC, 10% “jersey fibers, by weight. We will not be able to provide a binding classification on this material this time. Please identify the textile fiber and describe how the product is used, which surface goes against what.
The third and final sample of the L group is identified as Latex – antidorapant. It consists of a felt/nonwoven textile material composed of a polyester web and a polyethylene film laminated to a layer of latex rubber. The surface of the rubber portion has been embossed with a geometric pattern.
We will not be able to respond to this particular sample without additional information. Please identify method of polyester fabric production, i.e., felt/nonwoven (if nonwoven, indicate type of machine –wet or dry lay, etc). Also, indicate if constructed of staple or filament fibers. Finally, indicate what side of finished material would be against the table.
The applicable subheading for Plastifilm, Moltonap and Molleton, imported as piece goods, will be 5903.10.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for textile fabrics impregnated, coated, covered or laminated, with plastics, with polyvinyl chloride, of cotton. The duty rate will be 3.7 percent ad valorem.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
