RE: The tariff classification of two women’s garments from Taiwan

Dear Ms. Bonvissuto:

In your letter dated May 10, 2000, on behalf of Joyce Leslie, Inc., you requested a tariff classification ruling.

You submitted three samples. Style 7530 is a woman’s 100% wool, knit, sleeveless poncho-like garment that is pulled over the wearer’s head. It extends from the shoulders to below the chest but does not reach the waist. The garment features a roll down collar.

Style 7538 is a woman’s 50% mohair, 50% acrylic, 3x3 rib knit, sleeveless poncho that is pulled over the wearer’s head. The poncho extends from the shoulders to the waist. The garment features a turn down, turtleneck collar.

Style 7551 will be answered by National Import Specialist Angela DeGaetano.

Your samples are being returned as requested.

The applicable subheading for style 7530 will be 6114.10.0070, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s other garments, knitted: of wool or fine animal hair: other. The duty rate will be 14% ad valorem.

The applicable HTS subheading for style 7538 will be 6102.30.1000, which provides for women’s overcoats…capes…and similar articles, knitted, other than those of 6104: of manmade fibers: other: containing 23 percent or more by weight of wool or fine animal. The duty rate will be 66 cents/kg + 19.3% ad valorem.

Style 7530 falls within textile category designation 459. Style 7538 falls in category 435. Based upon international textile trade agreements products of Taiwan are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
