RE: The tariff classification of a novelty light from China.

Dear Mr. Vander Schuit:

In your letter dated August 8, 2000, you requested a tariff classification ruling.

The sample submitted, referred to as the “Litecube,” is a clear plastic ice cube-shaped light that measures approximately 1 3/8 inches high by 1 ¼ inches wide by 1 ¼ inches deep. It contains a refrigerant that is hermetically sealed within its body, in addition to a cartridge that houses a LED light and button-cell battery attached to the top portion of the cube. It features a lid, affixed atop of the lighting mechanism, with an interior sticker label indicating the manner of activating and deactivating the light. After being frozen solid and then lit, this item can be used in drinks, punchbowls and centerpieces during parties, weddings and other celebrations.

The applicable subheading for the Litecube will be 9405.40.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for other electric lamps and lighting fittings, other. The rate of duty will be 3.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
