RE: The tariff classification of a Cheerleader’s uniform from China and Hong Kong.
Dear Mr. Martin:
In your letter dated March 23, 2001, on behalf of Triston Enterprises, LLC, you requested a classification ruling.
The submitted cheerleader’s uniform consists of a pompom, V-Neck shell, mini pleated skirt, 16-pleat skirt, mid-riff top, scrunchie and boy-cut brief/shorts. All the garments will be women’s, sized in small to XX large.
Style PW-00412 pompom made from polyethylene plastic strips over 5mm in width.
Style PW-00410 Cheerleader sleeveless vest, “V-Neck Shell is composed of woven 100% polyester fabric that extends to the waist.
Style PW-00408 Cheerleader Mini Pleated Skirt composed of woven 100% polyester fabric. The skirt has a side zipper closing.
Style PW-00409 Cheerleader 16-Pleated Skirt composed of woven 100% polyester fabric. The garment has a back zipper closing.
Style PW-00411 Mock turtleneck bare midriff top composed of knit 100% nylon fabric. The garment has long sleeves elastic at the bottom and a back zipper closure. The garment is styled to bare the midriff.
Style PW-00413 The sample scrunchie is composed of woven nylon fabric. However you state that the imported scrunchie will be of knit nylon fabric.
Cheerleading shorts, no style #, boy-cut-brief/shorts are composed of knit 100% nylon fabric. The shorts have an elasticized waistband.
The applicable subheading for the pompom, style PW-00412 will be 3926.90.9880, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other articles of plastics and articles of other materials of headings 3901 to 3914: Other: Other, Other.” The duty rate will be 5.3% ad valorem.
The applicable subheading for the vest, style PW-00410 will be 6211.43.0076, Harmonized Tariff Schedule of the United States (HTS), which provides for “Track suits, ski-suits and swimwear; other garments: Other garments, women’s or girls: Of man-made fibers, Vests: Other.” The duty rate will be 16.3% ad valorem. The textile category designation is 659.
The applicable subheading for the mini pleated skirt, and the 16 pleat skirt, styles PW-00408 and PW00409 will be 6204.53.3010, Harmonized tariff schedule of the United states (HTS), which provides for “Women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts…Skirts, and divided skirts: Of synthetic fibers: Other: Other, Women’s.” The rate will be 16.3% ad valorem. The textile category designation is 642.
The applicable subheading for the mid-riff top, style PW-00411 will be 6114.30.1020, Harmonized tariff Schedule of the United States (HTS), which provides for “ Other garments, knitted or crocheted: Of man-made fibers: Tops, Women’s or girls’. The rate of duty will be 28.9% ad valorem. The textile category designation is 639.
The applicable subheading for the knit scrunchie, style PW-00413 will be 6117.80.8500. Harmonized Tariff Schedule of the United States (HTS), which provides for “ Other made up clothing accessories, knitted or crocheted…Other accessories: Other: Headbands, ponytail holders and similar articles.” The duty rate will be 14.9% ad valorem. Currently, there is no textile category designation for this merchandise.
The applicable subheading for the shorts, (no style number) will be 6104.63.2030, Harmonized Tariff Schedule of the United States (HTS), which provides “Women’s or girls’ suit…breeches and shorts…knitted or crocheted: Of synthetic fibers: Other: Other, Shorts: Women’s.” The duty rate will be 28.7% ad valorem. The textile category designation is 648.
Based upon international textile trade agreements products of China and Hong Kong are subject to quota and the requirement of a visa.
The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
