RE: The tariff classification of various storage bags from China.

Dear Ms. Lind:

In your letter dated March 29, 2002, on behalf of Franktex, Inc., you requested a tariff classification ruling.

The samples submitted are comforter bags, item numbers P1151, P1149 and P1150, bed bags, item numbers P1155 and P1154, a mattress pad bag, item number P1153, pillow bags, item numbers P1066 and P1152, and a pillow wrap, item number P1064. The bags are used to store bedding articles. All of the bags are made of cotton woven fabric.

Items numbers P1066 and P1152 are rectangular shaped pillow bags and measure approximately 28” x 20”. Item number P1066 features an envelope closure in the back and item number P1152 features a zipper closure along one side.

Item numbers P1155 and P1154 feature a zipper closure and a carry handle. The bags measure approximately 22”L x 27”H x 12”W and 22”L x 27”H x 7”W, respectively.

Item number P1153 features a zipper closure and measures approximately 15”L x 5”W x 18”H.

Item numbers P1151, P1149 and P1150 feature a drawstring cord closure. The bags measure approximately 20” in diameter and 30” in height, 15.5” in diameter and 27” in height and 18” in diameter and 30 inches in height, respectively.

Item number P1064 is made of a cotton woven fabric panel. The panel is folded and sewn closed.at the side. It measures approximately 12.5 diameter.

The applicable subheading for the above storage bags will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles . . . Other. The rate of duty will be 7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
