RE: The tariff classification of a Singer® Quilter's Kit from China.

Dear Mr. Roberts:

In your letter dated July 9, 2002, you requested a ruling on behalf of Dyno Merchandise Corp. on tariff classification.

You have described your item as a Singer® Quilter’s Maker Kit. The package you submitted consists of : 20 - Quilting & Craft Safety Pins (00206) - Steel 1 - 120” Tape Measure (00210) – Heavy duty vinyl 20 - Quilting Hand Needles (00259) 90 - Pearlized Straight Pins (00358) - Steel 1 - White Glaced Cotton Quilting Thread (66001) 1 - Ecru Glaced Cotton Quilting Thread (66002)

The Singer® Quilter’s Maker Kit meets the qualifications of "goods put up in sets for retail sale". The components of the set consist of at least two different articles which are, prima facie, classifiable in different headings. They are put together to meet a particular need or carry out a specific activity, and they are packed for sale directly to users without repacking. The items classifiable within heading 7319 (pins and needles) impart the essential character of the set.

The applicable subheading for this set will be 7319.30.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for Sewing needles, knitting needles, bodkins, crochet hooks, embroidery stilettos and similar articles for use in the hand, or iron or steel; safety pins and other pins of iron or steel, not elsewhere specified or included: Other pins: Dressmakers’ or common pins. The general rate of duty will be 4.1 percent ad valorem.

The cotton thread falls within textile category designation 200. Based upon international textile trade agreements, textile products of China are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

If imported separately, the applicable subheading for the cotton thread is 5204.20.0000, HTS. When imported as part of the Quilter’s Kit, the cotton thread will not be separately classified, however, they are still subject to quota/visa requirements.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177).
