RE: The tariff classification of stainless steel sheet from Sweden.
Dear Mr. Herman:
In your letter dated April 24, 2002 (faxed to us on July 25, 2002) on behalf of Alfa Laval, you requested a tariff classification ruling.
The product to be imported is Type 304 and Type 316 stainless steel cold-rolled quench annealed sheet measuring 2250 mm in length, 1000 mm in width and ranging from 0.4 mm to 0.8 mm in thickness. This flat-rolled sheet will ultimately be used in the manufacture of heat exchangers.
This stainless steel sheet, in its imported condition, meets the definition for flat-rolled products in HTS Chapter 72 Note 1. (k): “Rolled products of solid rectangular (other than square) cross section…in the form of…straight lengths, which if of a thickness less than 4.75 mm are of a width measuring at least 10 times the thickness….”
The applicable subheading for the cold-rolled stainless steel sheet measuring 0.5 mm to 0.8 mm in thickness will be 7219.34.0050, Harmonized Tariff Schedule of the United States (HTS), which provides for flat-rolled products of stainless steel, of a width of 600 mm or more, not further worked than cold-rolled (cold-reduced), of a thickness of 0.5 mm or more but not exceeding 1 mm, not in coils. The rate of duty will be 2 percent ad valorem.
The applicable subheading for the cold-rolled stainless steel sheet measuring 0.4 mm but less than 0.5 mm in thickness will be 7219.35.0050, HTS, which provides for flat-rolled products of stainless steel, of a width of 600 mm or more, not further worked than cold-rolled (cold-reduced), of a thickness of less than 0.5 mm, not in coils. The rate of duty will be 2 percent ad valorem.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
