RE: The tariff classification of a multi function image controller from Japan.
Dear Mr. Tamamoto:
In your letter dated September 9, 2002, on behalf of your client Fuji Photo Film USA Inc., you requested a tariff classification ruling.
The merchandise under consideration is the Multi Function Image Controller IC-660A. The IC-660A is one component of Fuji’s PrintPix DigiCam Picture Center, the other component being the NC-600D DigiCam Printer. The controller connects directly to the NC-600D DigiCam Printer. The IC-660A controller measures 11” wide x 4.7” high x 13.8” deep. The controller serves as a reader for most digital memory media (i.e. SmartMedia( and CompactFlash( cards, IBM Microdrive( and PC cards, etc.). The controller includes built-in slots for each type of card and can read media from PC Card Adapters, including Memory Sticks. The IC-660A has a 5.5” LCD (Liquid Crystal Display) screen on top of the controller with two control buttons, one for selecting the image you want and one to send the image to the printer for printing.
The Harmonized Commodity Description and Coding System Explanatory Notes (“EN’s”) constitute the official interpretation of the Harmonized System at the international level. While neither legally binding nor dispositive, the EN’s provide a commentary on the scope of each heading of the HTSUS and are generally indicative of the proper interpretation of these headings. Noting EN 84.71 (C) (2), machines for transcribing data onto data media in coded form and machines for processing such data would be included under this heading.
The applicable subheading for the Multi Function Image Controller IC-660A will be 8471.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for “…machines for transcribing data onto data media in coded form and machines for processing such data, not elsewhere specified or included…Other.” The rate of duty will be free.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
