RE: The tariff classification of 100% cotton printed plain woven fabrics from Ghana

Dear Mr. O’Connell:

In your letter dated November 12, 2002 you requested a tariff classification ruling.

Nine samples of woven fabric accompanied your request for a ruling. The letter also makes reference to 16 other styles that may be imported. The style numbers include DP342, MO62, N205, N497, S1527, RSP1283, RSP1405, RSP1447, RSP1456, RSP1517, RSP1549, RSP1579, RSP1743, RSP1753, RSP1783, RSP1801, RSP1899, RSP2011, RSP2048, RSP341, RSP425, RSP463 and RSP7. Each of the fabrics is identical in fiber content and construction and varies only in the design that has been printed onto the fabric. Each of the fabric is a printed plain woven fabric composed of 100% cotton. They each contain 26.77 single yarns per centimeter in the warp and 22 single yarns per centimeter in the filling. They have been constructed using 27/1 c.c. yarns in both the warp and filling. Weighing 123 g/m2, these fabrics will be in general be imported in 114 centimeter widths however they may be imported at times cut to 22.5” X 18” rectangles. Based on the data provided the average yarn number for these products has been calculated to be 39 in the metric system.

The applicable subheading for the all these plain woven fabrics will be 5208.52.3045, Harmonized Tariff Schedule of the United States (HTS), which provides for woven fabrics of cotton, containing 85 percent or more by weight of cotton, weighing not more than 200 g/m2, printed, plain weave, other, of number 42 or lower number, sheeting, other. The rate of duty will be 6.7 percent ad valorem

At the present time, products classifiable in subheading 5208.52.3045, HTS, which are products of Ghana are not subject to either quota restraints or visa requirements.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
