RE: The tariff classification of lanyards from Taiwan.
Dear Ms. Holland:
In your letter dated December 9, 2002, you requested a ruling on behalf of Identiphoto Co. on tariff classification.
You submitted two samples of lanyards, each made of a flat braid, with the ends of the braid joined by a plastic snap-clip. One is black, ¼” wide, with a metal ferrule creating a small loop that holds a metal j-hook. The other is green, slightly wider, with a plastic j-hook threaded onto it.
You state that the classification for the lanyards should be in subheading 5807.10.2020 Harmonized Tariff Schedule of the United States (HTS), which provides for “Labels, badges and similar articles of textile materials, in the piece, in strips or cut to shape or size, not embroidered: woven.” These are obviously not labels, although they may be intended to be clipped onto something akin to a label, such as an ID tag. However, Customs has ruled in HQ 965072, dated September 19, 2001, that such lanyards are classifiable as made up textile articles.
The applicable subheading for this product will be 6307.90.9889, HTS, which provides for other made up textile articles, other. The general rate of duty in 2002 and 2003 will be seven percent ad valorem.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177).
