RE: The tariff classification of textile window shade from Australia.
Dear Mr. Morison:
In your letter dated June 12, 2003 you requested a classification ruling.
The instant sample is a beige colored textile roller shade. The window shade is made from a man-made fiber woven fabric. Man-made fiber yarns are coated with plastic and the coated yarns are then are then woven into the shade fabric. The shade is mounted to a roller mechanism, which features a textile and plastic bead pull cord on one side. The roller shade is attached to a metal bracket and mounted on a wood base.
The applicable subheading for the shade (if made from synthetic fiber) will be 6303.92.2020, Harmonized Tariff Schedule of the United States (HTS), which provides for curtains (including drapes) and interior blinds; curtain or bed valances: other: of synthetic fibers: other… other. The duty rate will be 11.4 percent ad valorem.
The applicable subheading for the shade (if made of artificial fibers) will be 6303.99.0010, HTS, which provides for curtains (including drapes) and interior blinds: curtain or bed valances: other: of other textile materials… of artificial fibers. The duty rate will be 11.4 percent ad valorem.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
