RE: The tariff classification of auto door latches from Canada.
Dear Mr. Spencer:
In your letter dated June 16, 2003, you requested a ruling on tariff classification.
The merchandise is a number of different door latches and their striker. Parts 55346616 and 55346617 are right-hand and left-hand manual front door latches. Parts 55346614 and 55346615 are right-hand and left-hand power front door latches. The latches keep the door closed while the vehicle is being operated. When the door is closed, the latch contacts the striker, which is mounted on the door pillar.
In your letter, you suggest that the latches be classified in heading 8302, HTS, which provides for mountings and fittings of base metal. However, you describe the present merchandise as operable by means of a key or a radio-remote key fob. As you yourself point out in your letter, the Explanatory Notes to Heading 8301, HTS, indicate that fastening devices, operated by a key or radio wave signal, are classifiable in that heading.
The applicable subheading for this product will be 8301.20.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for locks of a kind used on motor vehicles, other. The general rate of duty will be 5.7 percent ad valorem.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.).
