RE: The tariff classification of certain used industrial equipment from unnamed countries
Dear Ms Kohn:
In your letter dated July 7, 2003 on behalf of Precision Lithographers USA Inc. you requested a tariff classification ruling.
Your client intends to import certain used industrial equipment which is presently located in Venezuela. The specific items are described in your ruling request as follows:
- Clark Equipment lift, model S40, type E, serial number S40-0019-4785FA, a manually pushed lift truck featuring a battery-operated pallet lift mechanism;
- Man Roland 6 color sheet-fed offset printing press with coating module, series 335, model R306LV, serial 18229, weighing approximately 35,000 kg;
- Polar 115 programmable paper cutter, #671108;
- Bush Gehard Maschinen - Graphische Maschinen programmable die cutter ESTA B, #6/493.
For purposes of this ruling, we assume all of these items were manufactured in a country entitled to the rates of duty listed in the General Rates of Duty column of the Harmonized Tariff Schedule of the United States.
The applicable subheading for the Clark model S40 will be 8427.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for fork-lift trucks; other works trucks fitted with lifting or handling equipment:: other trucks. The rate of duty will be free.
The applicable subheading for the Man Roland series 335 model R306LV will be 8443.19.9000, HTS, which provides for printing machinery used for printing by means of printing type, blocks, plates, cylinders and other printing components of heading 8442: offset printing machinery: other: weighing 1,600 kg or more. The rate of duty will also be free.
Finally, the applicable subheading for the programmable paper cutter and die cutter machines will be 8441.10.0000, HTS, which provides for other machinery for making up paper pulp, paper or paperboard, including cutting machines of all kinds: cutting machines. The rate of duty will again be free.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
