RE: The tariff classification of fan clutches from Canada and Mexico
Dear Mr. Forhart:
In your letter dated August 7, 2003 you requested a tariff classification ruling on behalf of your client Freightliner.
The articles in question are described as a fan clutch, part number 20822-3539, and two fan clutch assemblies, part numbers F6HT 8A627 AGB and KYS1293 0931401. All three items are for use in cooling systems for internal combustion engines for use in motor vehicles. The fan clutch allows torque from an engine shaft to drive a fan blade that in turn cools the engine and prevents overheating. When cooling is required the clutch automatically engages to drive the fan blade. When cooling is not required the clutch automatically disengages the fan blade from the engine shaft. Descriptive information and technical drawings were submitted.
The applicable subheading for the clutches will be 8483.60.4040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for clutches. The general rate of duty will be 2.8 percent ad valorem.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
