RE: The tariff classification of White Fused Aluminum Oxide, Glass Bead, Aluminum Shot, Garnet and Zirconia Alumina from China
Dear Ms. Ching:
In your letter dated February 18. 2004, on behalf of your client, S. L. Fusco Inc., you requested a tariff classification ruling.
The applicable subheading for the White Fused Aluminum Oxide will be 2818.10.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for Artificial corundum, whether or not chemically defined; aluminum oxide; aluminum hydroxide: Artificial corundum, whether or not chemically defined: In grains, or ground, pulverized or refined. The rate of duty is 1.3 percent ad valorem.
The applicable subheading for the Zirconia Alumina will be 3824.90.3900, Harmonized Tariff Schedule of the United States (HTS), which provides for Prepared binders for foundry molds or cores; chemical products and preparations of the chemical or allied industries (including those consisting of mixtures of natural products), not elsewhere specified or included; residual products of the chemical or allied industries, not elsewhere specified or included: Mixtures of two or more inorganic compounds: Other. The rate duty is Free.
We are unable to issue a classification ruling on the Aluminum Shot. The following information is required:
1. Please supply the chemical composition for the product.
2. Please supply a flow chart of the manufacturing process.
We are unable to issue a classification ruling for the Glass Bead. The following information is required:
1. Please indicate the manner in which the merchandise is produced or derived.
2. Is the glass ground to a very small size or is the merchandise produced in another manner?
3. Please provide the chemical composition.
4. What is the diameter of each bead? Are these items glass micro-spheres not exceeding one millimeter in diameter?
We are unable to issue a classification ruling on the Garnet Grits. The following information is required:
1. Is the Garnet naturally or synthetically produced?
2. Is this garnet simply derived from the earth? If so please indicate the precise extent to which it is worked.
3. Is the garnet produced synthetically? If so, please describe the precise method of manufacture. Even if the production begins with a natural mineral, if the molecular structure is changed during processing, the ultimate product will be regarded as synthetic.
4. Please provide a full flow chart detailing the production of this item and indicating every step at which the molecular structure changes.
When this information is available, you may wish to consider resubmission of your request. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
