RE: The tariff classification of bentonite clay sewn inside a cotton bag from China.
Dear Mr. Hoffacker:
In your letter July 9, 2004, on behalf of Bowler’s Superior Inventory, Inc., you requested a tariff classification ruling. Your samples are being returned.
Article# 00302 Get-A-Grip consists of crushed and dried bentonite clay permanently sewn inside a blue 100% cotton bag (6”L x 4”W x 0.5”H) and retail packed in clear plastic, for use by bowlers to absorb moisture from their hands while bowling. The bentonite clay imparts the essential character of the article.
The applicable subheading for the crushed and dried bentonite clay permanently sewn inside a cotton bag will be 2508.10.0000, Harmonized Tariff Schedule of the United States, which provides for bentonite. The duty is free.
Your article may be subject to the laws and regulations administered by the Consumer Product Safety Commission (CPSC). You may contact their office at 4330 East West Highway, Bethesda, MD 20814, telefax (301) 504-0012.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
A copy of the ruling or control number indicated above should be provided with entry documents filed at time merchandise is imported. For any questions regarding the ruling, contact National Import Specialist Frank Cantone at (646) 733-3038.
