RE: The tariff classification of socks from Mexico.
Dear Mr. Flores:
In your letter dated August 27, 2004 you requested a classification ruling.
The submitted samples are socks that are used in a hospital and/or clinical setting. The socks are made of knit polyester fabric with a slip-resistance tread design on the bottom.
You suggest three different classifications. Classification under 6210.10.5000 - items are made of knit fabric, subheading requires non-woven fabric; classification under 6405.90.2000 - items do not have an applied sole and classification under 6307.90.9889 - item is more specifically described as hosiery, therefore 6115 applies.
The applicable subheading for the socks will be 6115.93.9020, which provides for “Panty hose…socks…knitted or crocheted: Of synthetic fibers: Other: Other, Other.” The general duty rate will be 14.6% ad valorem.
The socks fall within textile category designation 632. Based upon international textile trade agreements products of Mexico are not subject to quota and the requirement of a visa.
The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
