RE: The tariff classification of various soccer related products from China, Taiwan or Pakistan
Dear Mr. Dente:
In your letter dated November 11, 2004, you requested a tariff classification ruling.
You are requesting the tariff classification on the following items: a plastic disc cone, style 4010, an inflatable polyurethane soccer ball, style 3125, a knitted 100% polyester soccer vest (pinnie), style 4000, a 100% nylon sports (ball) bag, style 3560, and a heat transfer decal, (no style number). The items are not considered a set; therefore they will be separately classified.
The applicable subheading for the soccer ball, style 3125, will be 9506.62.4080, Harmonized Tariff Schedule of the United States (HTS), which provides for articles and equipment for general physical exercise, gymnastics, athletics, other sports…or outdoor games, not specified or included elsewhere in this chapter…parts and accessories thereof: balls, other than golf balls and table-tennis balls: inflatable balls; soccer balls. The rate of duty will be free.
The applicable subheading for the plastic disc cone, style 4010, will be 9506.99.6080, Harmonized Tariff Schedule of the United States (HTS), which provides for articles and equipment for general physical exercise, gymnastics, athletics, other sports…or outdoor games, not specified or included elsewhere in this chapter…parts and accessories thereof: other…other. The rate of duty will be 4% ad valorem.
The applicable subheading for the vest (pinnie), style 4000, will be 6110.30.3035, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers (con): other (con): vests, other than sweater vests: women’s or girls’. The rate of duty will be 32% ad valorem.
The applicable subheading for the sports (ball) bag, style 3560, will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases, vanity cases…sports bags, and similar containers, of leather…of textile materials…: other: other…of man-made fibers: other. The rate of duty will be 17.6% ad valorem.
The applicable subheading for the heat transfer decal (no style number) will be 4908.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for transfers (decalcomanias): other. The rate of duty will be free.
The ball bag falls within textile category designation 670. The pinnie falls within textile category designation 659. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
