RE: The tariff classification of rolled wire profiles from China, Korea and Peru.
Dear Mr. Ordet:
In your letter dated December 21, 2004, on behalf of your client, Talon International, you requested a tariff classification ruling.
The products to be imported are rolled wire profiles of copper. The profiles are formed from round wire composed of between 86% and 89% copper, a maximum of .05% lead and a maximum of .05% iron. The balance consists of zinc. The rods are imported in coils and have a uniform cross section throughout their whole length. The diagram of the cross section submitted with your letter indicates that these profiles do not conform to the definitions or bar, rod, wire, plates, sheets, strip, foil, tubes or pipes.
The applicable subheading for the rolled copper profiles will be 7407.21.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for copper bars, rods and profiles, of copper alloys, of copper-zinc base alloys (brass), profiles, other. The rate of duty will be 2.2%.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Gloria Stingone at 646-733-3020.
Sincerely,
