RE: The tariff classification of a woman’s knit bolero-type jacket from Hong Kong

Dear Mr. Allan:

In your letter dated March 1, 2005, you requested a classification ruling. As requested, your sample is being returned to you.

Your sample, style CL102469, is a woman’s bolero-style jacket constructed from 66% silk, 31% nylon, 3% spandex knit fabric. The garment does not reach the waist. It features two front panels, a full front opening without a means of closure, and ¾ length sleeves finished with rib knit fabric.

In your ruling request, you recommended classification of the submitted garment under HTS 6114.90.9070. It is noted that style CL102469 has the silhouette and construction features common to a bolero-style jacket and; thus, is more specifically provided for in 6104.

The applicable subheading for style CL102469 will be 6104.39.2050, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear), knitted or crocheted: suit-type jackets and blazers: of other textile materials: other: other: other. The duty rate will be Free.

Style CL102469 falls within textile category designation 835. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
