RE: The tariff classification of gloves from China.

Dear Mr. Sachs:

In your letter dated March 28, 2005, you requested a tariff classification ruling.

The provided sample, Style HTG-3-K, consists of a 3-pair pack of cotton jersey gloves. Included in Style HTG-3-K are two gloves (Styles 91-1717T Brown Tree Camo and 91-1701T Blaze), which were previously classified in Ruling NY K89631 dated October 19, 2004. Style 91-1717T Brown Tree Camo was found to be a hunting glove classifiable under 6116.92.0800, HTS. Style 91-1701T Blaze was found to be a clute-cut work style glove with a ribbed knit cuff classifiable under 6116.92.6420, HTS. The third glove, Style 91-1501T Brown, is a brown colored version of style 91-1701T Blaze.

You have asserted classification for the 3-pair glove pack as hunting gloves under 6116.92.0800, HTS. Glove styles Style 91-1701T Blaze and 91-1501T Brown are not designed for use in the sport of hunting and would, therefore, not qualify as sport gloves.

The applicable subheading for Style 91-1717T Brown Tree Camo within Style HTG-3-K will be 6116.92.0800, Harmonized Tariff Schedule of the United States (HTS), which provides for Gloves, mittens and mitts, knitted or crocheted: other: of cotton: other gloves, mittens and mitts, all the foregoing specially designed for use in sports, including ski and snowmobile gloves, mittens and mitts. The rate of duty will be 2.8 percent ad valorem.

The applicable subheading for Styles 91-1701T Blaze and 91-1501T Brown within Style HTG-3-K will be 6116.92.6420, HTS, which provides for Gloves, mittens and mitts, knitted or crocheted: Other: Of cotton: Other: Made from a pre-existing machine knit fabric: Without fourchettes . . . Jersey type, brushed or napped fabric. The duty rate will be 23.5 percent ad valorem.

Styles 91-1701T Blaze and 91-1501T Brown within Style HTG-3-K fall within textile category designation 331. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
