RE: The tariff classification of upper body garments from China
Dear Ms. Kittel:
In your letter dated February 3, 2006 you requested a classification ruling.
Submitted style Q40632CH40 for girls, manufactured from rib-knitted fabric of 100% cotton, is a long-sleeved, turtleneck pullover, sized “M”. Submitted style Q40632CH12 for girls, manufactured from rib-knitted fabric of 75% acrylic/25% nylon that measures less than nine stitches per two centimeters, is a long-sleeved, round-necked pullover, sized “M”.
Submitted styles Q40676MR14 and Q40676MR12 for boys, manufactured from finely knitted fabric of 55% ramie/45% cotton that measures less than nine stitches per two centimeters, are sized “M” that is correspondingly larger than the “M” of the girls’ styles. The former boys’ style is a long-sleeved pullover, the partial-front, zippered opening of which extends into the high neckline; and the latter boys’ style is a long-sleeved, round-necked pullover.
As you have requested, the sample garments are being returned.
The applicable subheading for the boys’ garments will be 6110.90.9080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers…and similar articles, knitted…, of other textile materials, other, other, subject to man-made fiber restraints…boys’, other. The duty rate will be 6 per cent ad valorem.
The applicable subheading for style Q40632CH40 will be 6110.20.2079, HTS, which provides for sweaters, pullovers…and similar articles, knitted…, of cotton, other, other, other, …girls’, other; and for the remaining girls’ style will be 6110.30.3059, HTS, which provides for sweaters, pullovers…and similar articles, knitted…, of man-made fibers, other, other, other, other, other, …girls’, other. The duty rates will be 16.5 and 32 per cent ad valorem, respectively.

The boys’ garments fall within textile category designation 638, the girls’ cotton garment within 339, and the remaining girls’ garment within 639. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
