RE: The tariff classification of a kitchen towel from China.
Dear Ms. Kay:
In your letter dated February 3, 2006 you requested a classification ruling.
The merchandise at issue, identified as style K1739P, is a kitchen towel. The towel measures 16.5 inches by 27 inches. It is made from 100 percent cotton flat woven fabric. All four sides are hemmed. The center portion of the towel has a wide jacquard woven stripe depicting flowers. It is flanked on either side by a stripe in a waffle weave.
The applicable subheading for the towel will be 6302.91.0035, Harmonized Tariff Schedule of the United States (HTSUS), which provides for bed linen, table linen, toilet linen and kitchen linen: other: of cotton… other: towels: jacquard figured. The duty rate will be 9.2 percent ad valorem.

The kitchen towel falls within textile category designation 363. Textile category designation 363 from China falls within the recently announced quantitative restrictions between the United States and China, commonly referred to as China Safeguards or Safeguard Quotas. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information as to whether quota and visa requirements apply to this merchandise, we suggest that you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” available at our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
