RE: The tariff classification of a bleached polyester/cotton blend jacquard woven fabric from China.
Dear Ms. Garcia:
In your letter dated March 16, 2006 you requested a tariff classification ruling.
The submitted sample, designated as style “MG Border”, is a bleached jacquard woven fabric composed of 39.3% filament polyester, 34.2% staple polyester and 26.5% cotton. It is characterized by a complex weave creating a textured surface. The fabric contains 37.9 single yarns per centimeter in the warp and 20 single yarns per centimeter in the filling. Weighing 224 g/m2, this product will be imported in 228 centimeter widths.
The applicable subheading for the bleached jacquard woven fabric will be 5407.91.2090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for woven fabrics of synthetic filament yarn, including woven fabrics obtained from the materials of heading 5404, other woven fabrics, unbleached or bleached, other, other, other. The duty rate will be 14.9 percent ad valorem.

This fabric falls within textile category designation 629. At the present time this product is not subject to either quota restraints or visa requirements. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information as to whether quota and visa requirements apply to this merchandise, we suggest that you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” available at our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
