RE: The tariff classification of a work holding magnet from China

Dear Mr. White:

In your letter dated July 06, 2006, you requested a tariff classification ruling.

The merchandise subject to this ruling is a work holding magnet. The magnet, which will be made of sintered NeFB, nickel-plated will be in the form of a ring or disc, which will be .118” or 3mm thick. The outside diameter will be at least 16mm, not to exceed 22mm. It will have a hole through the center, .1905” in diameter on the bottom and .385” in diameter on the top. The beveled hole will allow users to mount the magnet by use of a flat-head wood or machine screw, without creating a protrusion on the top of the magnet. A steel work piece can be positioned to be stamped, rolled, punched, formed, or otherwise machines. The magnet can also be used as a temporary holder for tooling, to counteract gravity during the adjustment and registration of machine tools.

The applicable subheading for the work holding magnet will be 8505.90.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Electromagnets; permanent magnets and articles intended to become permanent magnets after magnetization; electromagnetic or permanent magnet chucks, clamps and similar holding devices: Other, including parts: Work holders and parts thereof.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
