RE: The tariff classification of a sock from China.
Dear Mr. Ashear:
In your letter dated July 13, 2006 you requested a tariff classification ruling. The ruling was delayed pending Customs Laboratory Analysis; the sample was destroyed during testing.
The submitted sample is a Style No. CW16834 Ladies Knee High Sock that measures 67 decitex or more per single yarn. Customs Laboratory analysis reveals that the sock is constructed of knit 50.4% ramie, 21% polyester, 20% cotton, 6.3% nylon and 2.3% spandex.
The applicable subheading for the Style No. CW16834 Ladies Knee High Sock will be 6115.99.8000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for panty hose, tights, stocking, socks and other hosiery…other: of other textile materials: other. The rate of duty will be 9.9 percent ad valorem.

Style No. CW16834 falls within textile category 832. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
