RE: The tariff classification of a chuck stop from Sweden

Dear Mr. Jakubowsky:

In your letter dated July 17, 2006 you requested a tariff classification ruling.

The chuck stop is used with a chuck for locating short parts in a 3-jaw lathe chuck while also keeping the workpiece consistently in place. Use of the aluminum chuck stop allows short parts to project past the chuck jaws, thus providing clearance for facing operations. The chuck stop also provides a fixed reference surface for workpieces to locate against. The web-shaped design eliminates the danger of using spacers or parallels that could come loose and be thrown from a spinning chuck. Three magnets secure the stop to the chuck face. Front and back locating surfaces are parallel within +/- 0.0004”. Slot width can be enlarged to accommodate wider chuck jaws. The chuck stops are available in various sizes, e.g., 15mm, 20mm, 25mm, 30mm and 35mm. During a telephone conversation with a member of my staff, you confirmed that the chuck stop is designed for use with metalworking machine tools.

In your letter, you suggest classification in (1) subheading 8466.20.8020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Parts and accessories suitable for use solely or principally with the machines of headings 8456 to 8465, including work or tool holders …: Work holders: Other … For metalworking machine tools: Jigs and fixtures, (2) subheading 8466.20.8035, HTSUS, which provides for Parts and accessories suitable for use solely or principally with the machines of headings 8456 to 8465, including work or tool holders …: Work holders: Other … For metalworking machine tools: Other or (3) subheading 8466.30.8000, HTSUS, which provides for Parts and accessories suitable for use solely or principally with the machines of headings 8456 to 8465 …: Dividing heads and other special attachments for machine tools: Other special attachments: Other: Other . The chuck stops are properly classified in subheading 8466.20.8020, HTSUS, as they are in the nature of jigs or fixtures for metalworking machine tools. In addition, the fact that the magnets are used to affix the chuck stop to the chuck rather than to physically hold the workpieces precludes the chuck stop from classification in subheading 8505.90.40, HTSUS, which provides for Electromagnets, permanent magnets and articles intended to become permanent magnets after magnetization; electromagnetic or permanent magnet chucks; clamps and similar holding devices; electromagnetic couplings; clutches and brakes; electromagnetic lifting heads; parts thereof: Electromagnetic lifting heads… Other, including parts: Work holders and parts thereof.

The applicable subheading for the chuck stop will be 8466.20.8020, HTSUS, which provides for Parts and accessories suitable for use solely or principally with the machines of headings 8456 to 8465, including work or tool holders, self-opening dieheads, dividing heads and other special attachments for machine tools; tool holders for any type of tool for working in the hand: Work holders: Other … For metalworking machine tools: Jigs and fixtures. The rate of duty will be 3.7 percent ad valorem.
