RE: The tariff classification of ladies’ swimming shorts from China.
Dear Ng:
In your letter dated October 24, 2006 you requested a classification ruling.
The submitted sample is a Style No. 231568 Ladies’ Swimming Short constructed of woven 100% nylon fabric. The short has no pockets and features an elasticized waist and lightweight knit mesh lining with a gusset. Its principal use is for swimming.
The applicable subheading for Style No. 231568 will be 6211.12.1010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: swimwear: women’s or girls’: of man-made fibers, women’s. The duty rate will be 11.8 percent ad valorem.

Style No. 231568 falls within textile category 659.
