RE: The tariff classification of a padlock from China

Dear Ms. Jewett:

In your letter dated October 12, 2006, you requested a tariff classification ruling.

The sample you submitted is described as a “Key Luggage Lock.” It is a small, Transportation Security Administration (TSA)-accepted padlock designed for use on luggage. The shackle and key ring are made of steel. The lock body, pins, springs, cylinder and keys are made of brass. The housing that covers the lock body is made of plastic.

The applicable subheading for the padlock will be 8301.10.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for padlocks and locks (key, combination or electrically operated, of base metal…padlocks, of cylinder or pin tumbler construction, not over 3.8 cm in width. The rate of duty will be 6.1 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
